These Terms of Service ("Terms") govern your use of the Railgo mobile application and the therailgoapp.com website (together, the "Service"), operated by Railgo LLC ("Railgo," "we," "us"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Railgo provides informational alerts only. It is not a safety device, warning system, or substitute for your own attention and judgment. Crossing information may be incomplete, delayed, or inaccurate, and a crossing may be active even when the app shows no alert.
Always obey all railroad crossing signals, gates, signs, laws, and the instructions of law enforcement and railroad personnel. Never rely on the app to determine whether it is safe to cross railroad tracks. Never interact with the app while driving except through hands-free or vehicle-integrated interfaces, and only as permitted by law.
Railgo helps drivers stay aware of railroad crossings by providing alerts and related information about crossings near you or along your route. The Service is currently in development; features described on this website may change before or after launch, and we may add, modify, or remove features at any time.
You must be at least 13 years old to use the Service, and you must be legally able to enter into these Terms. If you use the Service while operating a vehicle, you must hold a valid driver's license and comply with all applicable traffic and distracted-driving laws.
If the Service offers accounts, you are responsible for the accuracy of the information you provide and for activity under your account. You agree not to:
The Service may allow you to submit information, such as reports about crossing conditions. You retain ownership of what you submit, but you grant Railgo a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display that content to operate and improve the Service. You are responsible for your submissions and must only submit information you believe to be accurate. Never submit a report while actively driving.
Core features of the Service rely on your device's location. How we collect and use information, including location data, is described in our Privacy Policy, which is part of these Terms.
The Service uses data from third-party and public sources, including government crossing databases and mapping providers. We do not control these sources and are not responsible for their accuracy, availability, or completeness. Your use of third-party services linked through the Service is governed by their own terms.
The Service, including its design, software, branding, and content (other than your submissions), is owned by Railgo LLC or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, solely for your personal, non-commercial use and in accordance with these Terms and the rules of the app store from which you downloaded it.
If you download the app from the Apple App Store or Google Play, your use is also subject to that store's terms. Apple and Google are not parties to these Terms, have no obligation to provide support for the app, and are not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to apps downloaded from the App Store.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-interruption. Without limiting the safety notice above, we do not warrant that alerts will be delivered, timely, accurate, or complete, or that the Service will be error-free or uninterrupted.
To the maximum extent permitted by law, Railgo LLC and its officers, members, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Service — including any damages arising from reliance on crossing information, missed or inaccurate alerts, or events occurring at or near railroad crossings. To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of fifty U.S. dollars ($50) or the amount you paid us for the Service in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Railgo LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or where necessary to protect the Service or its users. Sections that by their nature should survive termination (including Sections 7, 9, 10, 11, and 13) will survive.
These Terms are governed by the laws of the State of Ohio and applicable federal law of the United States, without regard to conflict-of-law rules. You agree that disputes arising from these Terms or the Service will be resolved in the state or federal courts located in Ohio, and you consent to their jurisdiction.
We may update these Terms as the Service develops. The date at the top of this page reflects the latest revision. If changes are material, we will take reasonable steps to notify you, such as a notice in the app or on this website. Continued use of the Service after changes take effect means you accept the updated Terms.
